PLEASE READ THE FOLLOWING TERMS AND CONDITIONS RELATING TO YOUR USE OF THIS SITE CAREFULLY. The Procovery program web site is an information service provided by Procovery Institute LLC (”we,” “us,” or “our”), as a convenience to users to support their understanding of the Procovery program, with the express condition that users agree to be bound by the terms and conditions of this Terms of Use Agreement. By using this site, you are deemed to have agreed to these terms and conditions of use. We reserve the right to modify them at any time, and so you should check these terms and conditions periodically for changes. By using this site after we post any changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these terms and conditions of use, please do not use this site.
Scope of Terms and Conditions
These terms and conditions apply to your use of any page or site with procovery.com in the URL (“Main Procovery Website”), and any all of the sites and services we own or operate now or in the future that are hyperlinked to the Main Procovery Website, including but not limited to web-based education, training, ecommerce, bulletin board, blog, email loops or lists, or other documents or other information or communications services (collectively, the “Procovery Website” or “Website”). Unless we say otherwise, all references to the Website in these terms and conditions include all such pages, links, and sites. These terms and conditions do not apply to your use of unaffiliated sites to which the Procovery Website only links.

The contents of our sites are protected by copyright and trademark laws, and all rights are reserved except as otherwise specifically indicated. All content included on the Procovery Website, the compilation of such content, the look and feel of the pages, all software used, and all materials and documents displayed on or available (collectively “Procovery Institute Materials”) are the property of Procovery Institute and its content suppliers, and are protected by U.S. and international copyright laws. The Procovery Institute hereby grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Website and the information contained within it.
Unless you have received our express, written permission, you may not: (1) copy, reproduce, publish, distribute, download, create derivative works of, sell, transfer, display, transmit, compile or collect in a database, or in any manner commercially exploit, any of the Procovery Institute Materials or any copyright-protected element of the website; (2) make any use of the Procovery Institute Marks; (3) frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of Procovery Institute (including, but not limited to, images, text, page layout, and/or form); or (4) use any meta tags or any other “hidden text” utilizing Procovery Institute’s name or trademarks.
You must abide by all additional copyright notices or other restrictions contained in any part of the Website.

These terms and conditions apply only to the Procovery Website, and not to the sites of any other companies or organizations to which the Website may link. We are not responsible for the availability of any other site to which the Website links, and we do not endorse or take responsibility for the contents, advertising, products or other materials made available through such sites. You should direct any concerns to that site’s administrator or webmaster.
We may from time to time grant the owner of an approved website permission to use a hyper-text link on his or her web site, provided that any such grant must be in writing (including email) by the Procovery Institute and may be rescinded by PI at its sole discretion at any time, and follows the then current Procovery Link Guidelines, which as of this date are listed below:
1. The link must clearly be marked “Procovery program”;
2. The appearance, position and other aspects of either the link or the host website may not be such as to damage or dilute the goodwill associated with our name and trademarks;
3. The appearance, position and other aspects of either the link or the host website may not create the false appearance that an entity other than the Procovery Institute is associated with or sponsored by the Procovery Institute;
4. You will not abstract, add advertising, or otherwise in any way alter any Procovery web pages you link to.
5. The link, when activated by a user, must display this Website full-screen and not with a “frame” on the linked website. Under these terms, framing—the practice of intact reproduction of a page or pages of one website to another website—is deemed to be deceptive and a violation of our copyright rights. No authorization or permission is given for framing our content, whether in whole or in part;
6. Permission for reciprocal linking to the linking site is granted;
7. We reserve the right to rescind any linking permission at our discretion at any time; and
8. You recognize and agree to respect Procovery Institute copyrights and trademarks. PI trademarks are listed above in this the “Terms of Use” page on the Procovery.com website.

Submissions
We welcome your comments about any of the Sites and your contributions of your own stories and anecdotes about the power of the Procovery program. You grant us complete rights to use any comments, creative ideas, suggestions or other materials you send to us in any way we deem valuable to the Procovery program, in our sole discretion. Examples (without limitation) of our use may be in our publications, Sites, and marketing materials. Accordingly, we must ask that you not send us any original creative ideas, suggestions or materials unless you are granting us rights to use such materials in any way we deem valuable to the Procovery program, in our sole discretion and without compensation to you, including in our publications, on the website, and in our marketing literature. If, despite our request, you send us any creative idea, suggestion or material (”Submission”), it shall become our property. No Submission will be subject to any obligation of confidence by us, and we will not be liable for any use or disclosure of any Submission. We will exclusively own all known or later-existing rights to the Submission worldwide, and will be entitled to the unrestricted use of the Submission for any purpose, without compensation to the provider of the Submission.

Forums and Contributions
A “forum” means any message board, chat room, user review forum or other service appearing on any of the Websites where your contribution may be read by others, and includes both public boards and private folders. These Terms of Use constitute the entire agreement between you and Procovery Institute and govern your use of this Website. The failure of Procovery Institute to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this website or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
